Bracco files patent infringement complaint against Jubilant for rubidium-82 generators
Bracco Diagnostics has filed a complaint with the U.S. International Trade Commission (ITC) against radiopharmaceutical firm Jubilant DraxImage and two affiliates, citing patent infringement on its rubidium-82 generators.
The papers, filed March 27, argue the Canadian-based Jubilant violated the Tariff Act of 1930, and requested a cease-and-desist order to prohibit the sale of Jubilant’s Ruby elution system and Ruby-Fill rubidium-82 generators, which are commonly used in cardiac PET studies.
The request would also include Ruby elution systems and Ruby-Fill generators that have already been imported along with damages and injunctive relief.
The complaint prompted the ITC to issue an eight-day public comment period, during which the ITC will take public comments from any parties who use the technology in healthcare or have other interest. The comment period ends April 11.
