N.Y. imaging center files suit against CareCore National
Jericho Specialty Imaging (JSI), an imaging facility in New Hyde Park, N.Y., Monday filed an antitrust suit against CareCore National (CCN), in which JSI alleges CCN, an outpatient diagnostic imaging utilization management services provider, attempted to deny the center network participation.
JSI further alleges that CCN’s actions caused harm to competition in the radiology services market and harm to Oxford, Aetna, HIP and HealthNet subscribers in Nassau County and surrounding areas who are precluded from accessing their medical services.
The antitrust suit represents one of several lawsuits against the Wappingers Falls, N.Y.-based CCN filed by numerous imaging facilities in New York.
JSI serves pediatric and other special needs patients as well as routine adult patients. To maintain its relationships with referring physicians, the facility currently sees patients without regard to which insurer network covers them. Consequently, JSI has been constrained to provide services to patients covered by the CCN networks without payment.
“We had hoped that in time CareCore would change its position regarding admitting our facility based upon the extremely unique services we provide, and our special equipment, but unfortunately, this has not occurred,” said Allen Rothpearl, MD, owner of JSI.
JSI is represented in this action by Eisenberg & Carton, a Long Island, N.Y.-based law firm.
