Terumo fires back against Maquet patent infringe suit
Terumo Cardiovascular Systems filed a patent infringement complaint Aug. 21 in the Northern District of California against Maquet Cardiovascular, alleging that Maquet's Vasoview endoscopic vessel harvesting system infringes on of its patents.
The company said that the complaint also requests an injunction against further sales of the product in the U.S.
Maquet said it will continue to protect and enforce its intellectual property rights, and will aggressively defend the lawsuit filed by Terumo.
In April, Maquet filed patent infringement complaints against Terumo with the International Trade Commission and in the U.S. District Court for the Northern District of California, alleging that Terumo's VirtuoSaph endoscopic vessel harvesting system infringes two Maquet U.S. patents.
The Ann Arbor, Mich.-based Terumo said its VirtuoSaph system is used during coronary artery bypass grafting to remove the saphenous vein using very small incisions.
Terumo sells the VirtuoSaph endoscopic vessel harvesting system in the U.S. It is distributed in Japan and Asia by Terumo Corporation and in Europe by Terumo's European subsidiary.
In July, Terumo filed a patent infringement complaint in Germany against two affiliates of Maquet, alleging that two of Maquet’s endoscopic vessel harvesting systems, infringe Terumo’s German patents.
